Deferring Legal Fees Using Annuities

With a structured settlement annuity, attorneys can defer their legal fees. This option allows them to select payout dates and amounts at the time the deferral is finalized. In addition, the rate of return is fixed by some of the largest life insurance companies in the world.

Structuring attorney’s fees is a financially appealing option that exempts payments from income, interest, dividend, and capital gains taxes until fees are received.

Advantages:

  • Lower tax liability – attorneys may be able to reduce federal and state income tax liability on cases, as payments are only taxed when the income is received, sometimes resulting in lower taxes.
  • Produce stable retirement income.
  • Take advantage of options – can structure all or some of the attorney’s fees.
  • Explore possibility of increasing income by structuring your fees rather than taking a lump sum payment.
  • Customize to meet your specific goals.

Client FAQ

If any of the following statements or scenarios sound familiar,
then Professional Administration is likely a good fit for your client.

I have no idea what Medicare does and does not pay for. I thought Medicare paid for everything that my workers’ compensation carrier is paying for.

Professional Administration is recommended when a claimant is not familiar with Medicare-allowable and non-allowable expenses.

Is this claimant willing and able to comply with the CMS instruction that MSA funds may only be used to pay for injury related medical services that would normally be paid by Medicare?

I was advised that when my settlement is final and I open my Medicare set-aside account, I will need to use a fee schedule to pay my doctor and hospital bills. I do not know what a fee schedule is.

Professional Administration is recommended when a claimant is not familiar with workers’ compensation fee scheduling.

Is this claimant capable of properly managing payments and complying with CMS administration guidelines?

After my settlement is final and I open the Medicare set-aside account, my understanding is that when my doctors ask me to pay for treatment at the time of the visit, I just write a check from my MSA account and pay them for whatever they ask for.

Professional Administration is recommended when a claimant is not familiar with fee scheduling and Medicare coverage guidelines.

Is this claimant capable of managing payments and complying with CMS administration guidelines?

My injury was very severe, and I have a lot of physical limitations. I will still need a lot of medical treatment after my settlement is final and I don’t think I’ll be physically able to research fees or keep the paperwork and bills organized to meet CMS requirements.

Professional Administration is recommended when a claimant has serious or complicated medical conditions.
